[Personal Information Protection] Legislation on the Personal Information Protection Law

On April 17, 2023, the Vietnamese government issued Decree No. 13/2023/ND-CP stipulating the basic principles of personal data protection, laying the foundation for completing the institutional law on personal data protection. However, the legal framework for personal data protection still has many deficiencies, and at the same time, the trafficking of personal data that does not comply with the basic principles is becoming increasingly serious.

Given these circumstances, there is an urgent need to complete the legal framework for the protection of personal information, and to develop a personal information protection law that will promote the legitimate use of personal information and contribute to social development.

The department leading the development of the Personal Data Protection Law is the Ministry of Public Security. The current Personal Data Protection Law focuses on the rights of data subjects (which are to be developed into a domestic legal document with references to foreign laws) and the obligations of data subjects (such as the responsibility to protect their own personal data and to require other organizations and individuals to protect their personal data).

The Personal Data Protection Law is still in the process of gathering opinions and formulating its content, and will be updated in future newsletters.
