[Labor] Wage provisions for absence from work due to natural disasters

Many provinces in northern Vietnam that were directly hit by Typhoon Yagi (Typhoon No. 3) in early September 2024 have suffered serious economic and social damage from the flooding. Several enterprises have suspended operations, forcing workers to interrupt their work. In the event of such a work stoppage due to a natural disaster, employers and workers are required to agree on the following conditions for wages during the work stoppage, in accordance with Article 99(3) of the Labor Law

1. if the absence is for 14 working days or less: wages for the absence shall be based on mutual agreement, but shall not be less than the minimum wage
2. If the absence exceeds 14 working days: Wages for the absence shall be mutually agreed upon, but shall not be less than the minimum wage for the first 14 days.

Currently, the monthly minimum wage for each region ranges from VND3,450,000 to VND4,960,000. Employers are required to check the minimum wage in their locality and agree with their workers on how to handle absence from work.

Given the current situation of large-scale natural disasters in many provinces, employers are required to clearly understand the regulations for the protection of workers’ rights and provide appropriate financial support.
