[Labor] Vietnamese worker recruitment notification procedure before applying for work permit in Ho Chi Minh City

Based on Decree No. 70/2023/ND-CP on work permit applications, employers considering hiring foreign workers will be unable to issue, renew or exempt work permits from January 1, 2024. Before finalizing plans to use foreign workers for application purposes, it is necessary to complete notification procedures regarding the recruitment of Vietnamese workers.
In this newsletter, we will explain, as an example, how to post recruitment for Vietnamese workers at the Ho Chi Minh City Employment Service Center.

・Implementation deadline: At least 15 days before the scheduled date of submission of documents finalizing the plan to use foreign workers
・Implementation method:
+ Step 1: Create an account for your company on the website https://vieclamhcm.com.vn/
+ Step 2: Log in to the website https://vieclamhcm.com.vn/ using your account
+ Step 3: Fill in all the information in the input fields on the website and submit along with the recruitment notice signed and stamped by the employer according to the form provided by the Employment Service Center.
+ Step 4: Employment Service Center confirms the recruitment. Approval/disapproval results will be displayed on the website within approximately one business day.
– In the case of “Approval”, it is recognized that the recruitment information reception process has been completed. Employers must wait at least 15 days for information and referrals from employment service centers regarding candidates.
・In the case of “disapproval,” the Employment Service Center will send feedback to the employer via the registered email regarding information that needs to be added or adjusted. You will need to make additions and adjustments and resubmit until it is approved.
Posting can be done free of charge.

The above is the procedure for notification of recruitment of Vietnamese workers at the Ho Chi Minh City Employment Service Center. Employers located outside Ho Chi Minh City should check the procedures of the employment service center of the province/city where their head office is located and implement them appropriately.
