[Investment] Revisions and supplements to the document format for investment activities

On February 15, 2024, the Department of Planning and Investment issued Circular No. 25/2023/TT-BKHDT (“Circular 25”). Circular 25 partially amends and supplements Circular No. 03/2021/TT-BKHDT, which regulates document forms and reports related to investment in Vietnam, investment from Vietnam to foreign countries, and investment promotion.
Circular 25 amends and supplements a number of document forms applicable to investors in the following procedures

Group 1: Procedures related to investment activities in Vietnam
・Procedures for applying for and adjusting the issuance of investment registration certificates for investment projects.
・Procedures for investment in the form of capital contribution, share purchase, and equity purchase.
・Procedures for establishing, adjusting, and closing the administrative offices of foreign investors.
・Procedures for termination of investment projects.

Group 2: Procedures for investment activities from Vietnam to overseas
・Procedures for issuing and adjusting investment registration certificates for overseas investment.
・Reporting system for overseas investment activities
・Revocation procedures for overseas investment registration certificates.
Therefore, investors and enterprises, especially foreign-invested enterprises, should take care to properly use the latest regulatory document formats in carrying out the above procedures related to investment activities.
