[Labor] Proposal for Enactment of Personal Information Protection Law

The Ministry of Public Security has issued a document requesting the enactment of a new law on the protection of personal information, including two reports on the protection of personal information: a report assessing the status of social issues and a report assessing the impact of policies in the bill.

According to the document, the main issues related to personal data protection at present are as follows:
1. Although Vietnam has 69 legal instruments directly related to personal data protection, there is no uniformity in the concept and content of personal data and personal data protection
2. There is no law that specifically stipulates the conditions under which personal information may be used for business purposes. There are many companies that engage in such business activities, and there have been many cases of serious personal information leakage and damage involving tens of millions of people.
3. The sale, leakage, and loss of personal information are rampant, and laws and regulations concerning the handling of such information are not in place. The basic causes are as follows
・Lack of awareness of the issue of personal information protection.
・The government decree No. 13/2023/ND-CP on the protection of personal information is still incomplete, and companies are lagging behind in their response. In addition, the impact assessment of personal information processing and sending personal information overseas and notification of personal information protection violations have not yet been established.
・Sanctions have not yet been developed.

In order to resolve the above issues, the Ministry of Public Security has proposed the enactment of a new “Personal Information Protection Law” and is currently soliciting opinions from various ministries, organizations, and individuals.
