Urgent measures with Decree 13
On April 17, 2023, the Vietnamese government issued Decree 13/2023/ND-CP related to personal data protection in Vietnam (hereinafter referred to as Decree 13) for the first time, effective from July 1 of the same year. In 2024, it is expected that sanction regulations for non-compliance with this decree will be officially issued, so many enterprises are urgently preparing to deal with it.
The definition of “personal data” in Vietnam
“Personal data” refers to electronic information in the form of symbols, letters, numbers, images, sounds, or equivalences associated with an individual or used to identify an individual. The personal data includes general personal data and sensitive personal data.
General personal data includes
- Last name, middle name and first name, other names (if any)
- Date of birth
- Place of birth, registered place of birth; place of permanent residence; place of temporary residence; current place of residence; hometown; contact address
- Nationality
- Phone number; ID Card number, personal identification number, passport number, driver’s license number,…)
- Information about the individual’s family relationship (parents, children)
- Information about the individual’s digital account
Sensitive personal data includes
It is personal data associated with the privacy of an individual (information that infringes on the rights and interests of individuals
- Political views
- Religious views
- Medical records (excluding blood type information)
- Criminal record
Necessary obligations that businesses must fulfill
According to the provisions of Decree 13, enterprises need to perform the following obligations.
- Establish internal regulations related to the protection of personal data.
- Draft and keep impact assessment documents related to the processing of personal data and the transfer of personal data abroad.
- Submit the above two documents to the Ministry of Public Security in Hanoi.
- Notify and obtain consent from entities related to the processing of personal data (including employees, suppliers, business partners, etc.).
- Establish measures to protect personal data.
- Obligations when violations of law related to the protection of personal data occur.
